各方回应“南大碎尸案”家属喊话，“张译躺枪”！警方誓言追凶到底

12月17日，“南大碎尸案”被害人刁爱青的姐夫公开给演员张译致信称，“爱青29年前在南京大学读书期间被凶手残忍地杀害。案件至今没有侦破，我们全家希望时间可以抚平我们的伤痛，让我们可以遗忘！”但是张译主演的电视剧《他是谁》在2023年热播，剧中的“余爱芹案”与“南大碎尸案”高度相似。

The brother-in-law of Diao Aiqing, the victim of a dismemberment case at the Nanjing University in 1996, publicly penned a letter to actor Zhang Yi on Tuesday, highlighting the striking resemblance between the "Yu Aiqin case" depicted in the popular 2023 TV drama "Who is He", where Zhang Yi stars, and the actual events of the "Nanjing University dismemberment case".

最让家属难以接受的是，剧中还虚构了“余爱芹”婚外情的剧情。“这些毫无根据的胡编乱造不仅是对我死去妹妹的极大侮辱，更是给我们全家造成了巨大的伤害，让我岳父母受不了打击，一直卧床不起！”

信末，刁爱青的姐夫希望该剧主演张译能站出来为家属发声。家属要求出品人、播出方停止对逝者的恶意消费，主动承担起应有的法律责任。

The portrayal of "Yu Aiqin" engaging in an extramarital affair in the show is deemed unacceptable by Diao's family, causing significant distress. Consequently, they seek Zhang Yi's advocacy and urge producers and broadcasters to cease their exploitative practices and uphold their legal obligations.

代理律师深夜发声明

“南大碎尸案”被害人代理律师、北京安剑律师事务所周兆成律师昨天深夜通过社交平台，发布关于电视剧《他是谁》侵犯“南大碎尸案”被害人刁爱青亲属权益的律师声明。其中明确要求相关制作公司和播放平台，停止播放侵权剧集、删除相关宣传资料等，并在公开渠道发布诚恳道歉声明。

北京京本律师事务所主任连大有律师表示，根据《民法典》第1024条和1032条，民事主体都享有名誉权和隐私权。影视作品在对真人真事改编时，如果加入一些与事实不符的虚构情节，导致公众对原型人物的认识、评价出现偏差，甚至朝向不好的方向发展，那么这种改编可能构成对原型人物名誉权的侵犯。

Under Articles 1024 and 1032 of the Civil Code, individuals are entitled to rights of reputation and privacy. When movies and TV shows adapt real events and introduce fictional elements that distort the truth, causing the public's perception and judgment of the real-life figures to veer off course, potentially in a negative light, such adaptations may infringe upon the reputation rights of those individuals, said Lian Dayou, director of Beijing Jingben Law Firm.

被害人家属：只是想借张译的热度维权

据极目新闻报道，2023年5月，刁爱青的姐夫得知《他是谁》中有“南大碎尸案”的情节后专门去看了该剧。

他发现，剧中余爱芹案与妹妹被害案高度相似。电视剧播出之前，相关方没有与家属沟通，还虚构了“余爱芹出轨”的内容。

“张译平白无故躺枪，我也很不好意思，我们想借助他的热度来维权。”刁爱青的姐夫说，家属已不再要求精神赔偿，只希望出品方可以下架作品并道歉。

12月17日，万达电视剧公司回应称，《他是谁》是万达电视剧联合出品的项目，于2022年完成立项、备案与拍摄，最终在2023年3月播出。今年4月，万达电视剧方面接到法院送达的起诉状等资料。在法院组织协调下，目前公司积极与当事人律师进行沟通。万达方面表示，充分理解当事人心情，高度重视当事人诉求。目前正与当事人律师在法院组织协调下持续就相关内容进行协商。

警方誓言追凶到底

公开资料显示，“南大碎尸案”案发于1996年，南京大学成人教育学院一年级女学生刁爱青，在校期间被凶手残忍杀害，尸体被一名清洁工发现。

该案多年来未曾侦破，2016年1月，公安部刑侦局官方微博辟谣该案超过追诉期，称警方必将依法追查到底，绝不放弃。

The "Nanjing University dismemberment case" remained unsolved for years. In January 2016, the official Weibo account of the Criminal Investigation Bureau of the Ministry of Public Security refuted rumors of the case exceeding the statute of limitations, promising to continue the investigation relentlessly within the law.
